Last-Chance Remedy Notice

Give your council one clear, final chance to put things right before you appeal to the Tribunal or complain to the Ombudsman. Ada drafts a firm, professional pre-proceedings letter that sets out the law, the fix you need, and a deadline.

Track missing provision first. Losing 1:1 hours, therapy or a placement? Log every missed session in the Provision Tracker to build a dated evidence file for your remedy notice and any Ombudsman complaint.

Why councils listen. The SEND Tribunal is a "no-costs" jurisdiction — you usually can't recover your own costs, but you can't be ordered to pay the council's either. In 2022/23 the Tribunal decided over 98% of SEND appeals in families' favour (Ministry of Justice). A clear, documented last-chance notice often gets things put right sooner — saving your family months of stress and keeping the focus on your child.

Where a child is out of school (including exclusion), the council must arrange suitable education — for a permanent exclusion, from the sixth school day.

Will this succeed? Check your case

Describe what's happened and Ada gives you an honest read on how strong it is, which route fits — First-tier Tribunal (SEND) or the Local Government & Social Care Ombudsman — the law behind it, the steps you must complete first, and what would strengthen your case. This is guidance to help you decide, not legal advice or a prediction of the outcome.

Please don't include names, dates of birth, NHS or EHCP numbers.
